Rep. Whitecloud files motion to disqualify Attorney General

Rep. Whitecloud charged with felony counts

OKMULGEE – On March 2, attorney Ryan Connonie, representing Muscogee (Creek) Nation National Council member Robyn Whitecloud, filed two motions in the MCN District court. Whitecloud was charged with four felony counts of preventing or attempting to prevent performance of official acts on Jan 16, as previously reported.

Connonie filed a motion to disqualify the Attorney General’s Office and to appoint a special prosecutor in the case. The motion points out that Whitecloud is a seated representative who can vote on matters concerning the Attorney General’s office, creating a conflict of interest for the prosecution. The motion also notes that Rep. Whitecloud voted against the confirmation of Attorney General Geri Wisner. The motion requests that the court appoint an independent special prosecutor.

In addition to this motion, Connonie also filed a motion to quash the search warrant used in the case. Quash is a legal term meaning to suppress, nullify, or set aside. This motion asserts that the search warrant issued to confiscate Whitecoud’s cell phone was overly broad and thus violated constitutional protections against “General warrants”.

Whitecloud is scheduled to appear in court again on April 6, and arguments on the motions are expected to be heard then. Mvskoke Media will have ongoing coverage of this developing story.
