OKMULGEE – The Muscogee (Creek) National Council held an emergency session at the Mound Building on Aug 28. All of the following legislation will appear as ballot initiatives in the 2026 MCN Special Election, scheduled for Saturday, May 30. Voters will have the option to select “Yes” or “No” for the amendment. A 2/3 supermajority is required for the amendment to pass. The amendments in this session included revised language in the bills and language that will appear on the ballot. The recommendations were given to the MCNNC from the MCN Election Board.
The council addressed the following legislation, the interpretation of which is attributed to language in the bill:
NCA 26-060 A law of the Muscogee (Creek) Nation amending NCA 25-109 (A law of the Muscogee (Creek) Nation amending the Constitution of the Muscogee (Creek) Nation by replacing “Muscogee” with the traditional spelling of “Mvskoke” and deleting the word “Creek” throughout the Constitution). Representative Thomasene Osborn sponsored the legislation, which was adopted with a vote of 14-0.
If the amendment is passed by voters, it will revise language in the constitution because “Mvskoke” is the traditional spelling of the tribe’s name. It will also add parentheses around the word “Creek” before and after, which was missing from the original legislation. That word will be deleted from the constitution. It also deleted “For the amendment” in the ballot language.
NCA 26-061 A law of the Muscogee (Creek) Nation amending NCA 26-030 (A law of the Muscogee (Creek) Nation to amend Article VII of the Constitution of the Muscogee (Creek) Nation regarding Supreme Court Justices). Representative Robert Hufft sponsored the legislation, which was adopted with a vote of 14-0.
If the amendment is approved by voters, it will allow special justices to be appointed in cases in which one or more Supreme Court justices must recuse themselves. This is to ensure that each case is heard by seven justices. The special justice’s tenure will expire following the conclusion of the case to which they are appointed. The language “shall” was added to the amendment, and the term “for the amendment” was deleted.
NCA 26-062 A law of the Muscogee (Creek) Nation amending NCA 26-031 (A law of the Muscogee (Creek) Nation to amend Article IX of the Constitution of the Muscogee (Creek) Nation regarding Special Elections). Rep. Hufft sponsored the bill, which was adopted with a vote of 14-0.
If the amendment is passed by voters, it will give the principal chief the ability to call a special election with a general election. The special election must be called 90 days before the general election. The language, “shall the proposed language be approved,” and “for the amendment,” was deleted.
NCA 26-063 A law of the Muscogee (Creek) Nation amending NCA 25-105 (A law of the Muscogee (Creek) Nation amending Article VI Section 2 (a) of the Constitution of the Muscogee (Creek) Nation to establish term limits for National Council Representatives) as amended by NCA 26-038. Rep. Osborn sponsored the legislation, which was adopted by a vote of 14-0.
If the amendment is passed by voters, it will restrict MCN National Council Representatives’ term limits to three, consecutive or non-consecutive. It will also take effect during the 2027 election. The words “shall” and “cycle” were added to the language to disambiguate between primary and general elections in previous legislation. The term “after this article is effective” was deleted.
