OKMULGEE, Oklahoma – MCN National Council Rep. Joseph Hicks has plead no contest to a first offense misdemeanor DUI charge in MCN District Court.
MCN Code establishes that the first time a citizen is charged with DUI, the charge is a misdemeanor, and if the citizen has a second DUI offense it is a felony.
As previously reported, the MCN Attorney Generals office mistakenly charged Rep. Hicks with a felony DUI on April 25, 2022.
The original felony charges listed a prior DUI conviction, and that conviction was for a different individual.
Mvskoke Media reported on the felony charges, pointing out in the coverage that the prior conviction listed was for an individual who had a different birthdate.
On June 8, 2022, the charges were refiled as a first offense DUI, which is a misdemeanor.
Rep. Hicks has been sentenced to one year probation which will end in September of 2023.
As part of the conditions of his probation, Rep. Hicks is forbidden from entering any establishment that serves or sells alcoholic beverages and is forbidden from owning, carrying or possessing firearms or ammunition.
