MVSKOKE RESERVATION – On Thursday, July 16, the Business, Finance, and Justice Committee held an in-person meeting. Passed legislation will go on to the next full council meeting, unless otherwise noted.
The committee addressed the following legislation, the interpretation of which is attributed to language in the bills:
TR 26-042 A tribal resolution of the Muscogee (Creek) Nation authorizing the Principal Chief to execute an engagement letter for legal services between the Muscogee (Creek) Nation Department of Commerce and the AIM Law, Limited Partnership. Representative William Lowe sponsored the legislation, which passed 2-0.
According to the legislation, outside legal counsel representing the Nation requires approval by a Tribal resolution.
TR 26-043 A tribal resolution of the Muscogee (Creek) Nation authorizing the Principal Chief to execute an engagement letter for legal services between the Muscogee (Creek) Nation Department of Commerce and the Jacobson Law Group. Rep. Lowe sponsored the bill. It passed 2-1. Rep. Golden opposed the bill.
The engagement letter is required in order for MCN Department of Commerce to receive legal services from AIM Law.
TR 26-044 A tribal resolution of the Muscogee (Creek) Nation approving and authorizing the Muscogee Nation Gaming Enterprises, LLC (“MNGE”) Board of Directors to execute the third amendment to the Margaritaville Trademark Sub-License Agreement. Representative Robert Hufft sponsored the bill, and Representative Lucian Tiger co-sponsored it. The bill passed 2-1. Rep. Golden opposed the bill.
According to the legislation, the agreement will extend the Margaritaville operating agreement for five years, ending on Monday, August 25, 2031.
TR 26-045 A tribal resolution of the Muscogee (Creek) Nation establishing the Tribal Digital Infrastructure and Data Sovereignty Task Force and providing for coordinated development of Tribal digital infrastructure initiatives on the reservation. Representative James Factor sponsored this bill. Speaker Randall Hicks, Representative Cody Phillips, and Rep. Tiger co-sponsored the bill. It passed 2-1. Rep. Golden opposed the bill.
According to the legislation, the task force will include one representative from the Attorney General’s office, one representative from the National Council, the principal chief, the chairman of the BFJ committee, the Speaker of the National Council, and one representative from the Tribal Utility Authority.
NCA 26-099 A law of the Muscogee (Creek) nation approving and authorizing the Principal Chief to execute and file the Articles of Organization with the Office of the Secretary of the Nation to form “Muscogee Studios, LLC” under the Muscogee (Creek) Nation Limited Liability Company Act and approving the operating agreement for “Muscogee Studios, LLC.” Rep. Lowe sponsored the bill. It was postponed indefinitely, 3-0.
If adopted, the studio will “engage in economic development ventures and other activities in furtherance of governmental objectives of the Nation and for the advancement of its members.”
NCA 26-100 A law of the Muscogee (Creek) Nation appropriating funds to Muscogee Studios, LLC. Rep. Lowe sponsored the bill. It was postponed indefinitely, 3-0.
If adopted, the studio will receive $375,000 in funding.
NCA 26-101 A law of the Muscogee (Creek) Nation amending NCA 18-057 (A law of the Muscogee (Creek) Nation approving and authorizing the Principal Chief to execute and file the articles of organization with the Office of the Secretary and Commerce to form “Fountainhead Creek Golf Course, LLC” under the Muscogee (Creek) Nation Limited Liability Company Act and approving the operating agreement for “Fountainhead Creek Golf Course, LLC”. Rep. Lowe sponsored the legislation, which was postponed indefinitely 3-0.
If adopted, “Fountainhead Creek Golf Course, LLC” will become a limited liability company wholly-owned by the Nation.
NCA 26-102 A law of the Muscogee (Creek) Nation amending Title 17, Chapter 2, entitled “Trade and Commerce Authority” and establishing the Muscogee (Creek) Development Corporation. Rep. Lowe sponsored the bill. It was postponed indefinitely, 3-0.
If adopted, the legislation will amend the language “Authority” to “Corporation.” It adds language updating the authority and makeup of the Trade and Commerce Authority board.
NCA 26-103 A law of the Muscogee (Creek) Nation amending NCA 26-046 (A law of the Muscogee (Creek) Nation approving and authorizing the principal chief to execute and file the articles of organization with the office of the secretary of the nation to form “MCN Outdoor, LLC” under the Muscogee (Creek) Nation Limited Liability Company Act and approving the operating agreement for “MCN Outdoor, LLC”) Rep. Factor sponsored the bill. It was postponed indefinitely, 3-0.
If adopted, “MCN Outdoor LLC” will become a limited liability company wholly-owned by the Nation.
NCA 26-108 A law of the Muscogee (Creek) Nation creating a new Chapter 11, entitled “The Muscogee (Creek) Development Corporation” in MCNCA Title 17.
If adopted, the new chapter will define the authority of the “Muscogee (Creek) Development Corporation.” It will grant it the ability to carry out business and economic development projects. It will also define the makeup of a board of trustees and officers.
NCA 26-109 A law of the Muscogee (Creek) Nation amending MCNCA Title 37, § 2-203 entitled “Permanent Fund.” Rep. Hufft and Rep. Tiger sponsored the bill. It passed 3-0.
According to the legislation, it adds language to include an employee raise/initiative fund and a cultural and language fund, both supported by the MCN permanent fund.
