BFJ passes bills to update criminal codes

The bills include contraband in MCN jails and definitions of battery and maiming

Bills to assist child witnesses and law enforcement passed by BFJ

MVSKOKE RESERVATION – On Jan. 22, the Business, Finance, and Justice Committee held an in-person meeting. Passed legislation will go on to the next full council meeting, unless otherwise noted.

The committee addressed the following legislation, the interpretation of which is attributed to language in the bills:

TR 26-002 A tribal resolution of the Muscogee (Creek) Nation confirming the nomination of Janet Maylen to serve on the Mvskoke Loan Fund board was passed with a vote of 4-0. Representative James Factor sponsored the legislation.

If adopted, this resolution will allow Janet Maylen to serve on the Mvskoke Loan Fund’s Board of Directors for three years, with her term beginning on the date of her confirmation.

TR 26-003 A tribal resolution of the Muscogee (Creek) Nation approving and authorizing the Muscogee Nation Gaming Enterprises, LLC (“MNGE”) Board of Directors to execute World Wide Technology Quote 7584169.2 was passed with a vote of 4-0. Representative Robert Hufft sponsored the legislation.

If adopted, this resolution will allow MNGE to pursue a 5-year technology contract for cloud services.

NCA 26-015 A law of the Muscogee (Creek) Nation creating MCNCA Title 14, Subsection 2-636 entitled “Contraband in Jails” was passed with a vote of 4-0. Representative William Lowe sponsored the legislation.

If adopted, this law will establish the rules regarding contraband in any jail or detention facility of the Muscogee Nation reservation.

NCA 26-016 A law of the Muscogee (Creek) Nation creating Title 14, Subsection 2-346 entitled “Disruption or Prevention of Emergency Telephone Call” and creating Title 14, Subsection 2-347 entitled “Maiming” was passed with a vote of 4-0. Rep. Lowe sponsored the legislation.

If adopted, this law will establish the definition and penalties for the crimes of intentionally interfering with emergency communications and of intentionally inflicting serious injury resulting in disability, disfiguring, or other problems.

NCA 26-017 A law of the Muscogee (Creek) Nation amending Title 14, Subsection 2-303 entitled “Battery” was passed with a vote of 4-0. Rep. Lowe sponsored the legislation.

If adopted, this law will amend the definition of “Protected Status Battery” to include any medical personnel as well as teachers, school officials, referees/umpires, children under 15 years old, a person aged 62 years or older, an incapacitated person, or a person being targeted due to their race, religion, ancestry, nationality, sexual orientation, or disability.

NCA 26-018 A law of the Muscogee (Creek) Nation authorizing the expenditure of grant funds awarded from the Oklahoma Native Assets Coalition for the benefit of the Office of the Secretary of the Nation was passed with a vote of 4-0. Rep. Factor sponsored the legislation.

If adopted, this law will award $10,000 in grant funds to purchase computers and office supplies for the Muscogee Nation VITA Tax Program.

NCA 26-019 A law of the Muscogee (Creek) Nation establishing a new Title 36, Chapter 10, entitled “Vapor Products Code” was passed with a vote of 4-0. Rep. Factor sponsored the legislation.

If adopted, this law will allow the MCN to regulate the sale and use of vapes, e-cigarettes, hookahs, and other vapor products.

NCA 26-020 A law of the Muscogee (Creek) Nation repealing Title 16, Chapter 5, Subchapter 3 entitled “Department of Tourism and Recreation” and amending MCNCA Title 16, Chapter 11 entitled, “Secretary of Commerce” and creating new subchapters entitled “Marketing”, “Tourism”, and “Recreation” and authorizing an appropriation for the new Tourism Department was passed with a vote of 4-0. Rep. Lowe sponsored the legislation.

If adopted, this law will amend the duties of the Secretary of Commerce and approve an appropriation of $264,939.71 for the Tourism Department’s budget.

NCA 26-021 A law of the Muscogee (Creek) Nation authorizing a supplemental appropriation for the Muscogee (Creek) Nation Festival Fiscal Year 2026 Budget was passed with a vote of 4-0. Rep. Hufft sponsored the legislation.

If adopted, this law will approve the appropriation of $833,000 for 2026 Muscogee Nation Festival and its 50th anniversary celebration.
