Grayson and Kennedy file in federal court

The complaint seeks injunctive relief against Principal Chief Hill and MCN Citizenship Board Members.

OKLAHOMA CITY – Rhonda Grayson and Jeffery Kennedy filed a civil suit in the United States District Court for the Western District of Oklahoma on July, 23.  The suit seeks injunctive relief against Muscogee (Creek) Nation Principal Chief David Hill and members of the MCN Citizenship Board. 

In addition, the suit asks the federal court to recognize the MCN Supreme Court decision in Citizenship Board v. Grayson and to issue a declaratory judgment affirming that the Treaty of 1866 grants all MCN citizenship rights to Grayson and Kennedy.

The complaint points out that two elections have been held since the 2025 Citizenship Board v. Grayson decision granted Mvskoke Freedmen descendants Tribal citizenship. The most recent May 2026 MCN Special Election amended the Nation’s constitution, allowing the Principal Chief and the MCN National Council to appoint justices to the high court when a justice has recused. The complaint alleges that holding elections before Freedmen were issued citizenship cards infringed on their right to vote in Tribal elections.
