OKMULGEE – Muscogee Creek Nation National Council Representative Robyn Whitecloud appeared in the MCN District Court on Monday, May 4. Whitecloud was charged with four felony counts of preventing or attempting to prevent performance of official acts on Jan 16.
As previously reported, attorney Ryan Connonie, representing Whitecloud, filed two motions in the MCN District court on March 2. Judge Nalani Ching heard oral arguments on the motions at the May 4 hearing.
Connonie had filed a motion to disqualify the MCN Attorney General’s Office and to appoint a special prosecutor in the case, as well as a motion to quash the search warrant used in the case. Quash is a legal term meaning to suppress, nullify, or set aside. This motion asserts that the search warrant issued to confiscate Whitecoud’s cell phone was overly broad and thus violated constitutional protections against “general warrants.”
Connonie withdrew the motion to quash the search warrant, stating that the MCN Attorney General’s office had returned Whitecloud’s cell phone, so the motion was unnecessary. After hearing oral arguments on the motion to disqualify the MCN Attorney General’s office, Judge Ching did not grant the motion.
