OKMVLKE, Oklv. – The Muscogee (Creek) Nation Supreme Court has issued a stay in the case of the Citizenship Board of The Muscogee (Creek) Nation v. Rhonda K. Grayson and Jeffrey D. Kennedy. The case was scheduled for oral arguments on July 26.
According to the order, on July 8 an application was filed with the MCN Supreme Court, which seeks to have the court assume original jurisdiction and declare NCA 24-077 unconstitutional. NCA-077 is a recently passed law that amended Title 27 creating a new “Special Justice” position on the MCN Supreme Court. While the court hears briefs from the parties in this new action, all cases filed in which NCA 24-077 is implicated are to be stayed.
As previously reported, Rhonda Grayson and Jeffery Kennedy won their case in the Muscogee Creek Nation District Court. They filed suit seeking to have their applications for citizenship evaluated based on the 1866 treaty. The case was then appealed to the MCN Supreme Court.
